ORDER NO. 01-002

OCCUPANCY AND USE

Dakota Prairie National Grasslands


Pursuant to CFR 261.50 (a) and (b) the following acts are prohibited on the areas, roads and trails described in this order, within the Dakota Prairie National Grasslands.

1. Possessing, storing or transporting feeds, hay, straw, cubes or mulch that is not certified as being noxious weed free or noxious weed seed free by a state Certified Weed Control Agent or County Extension Agent. Each individual bale or containers certified as noxious weed free or noxious weed seed free must be identified with the program's appropriate tag or mark (36 CFR 261.58 (t))

2. Possessing, storing or transporting out of state feeds, hay, straw or mulch that has not been certified as weed seed free forage by the state of origin. (36 CFR 261.58 (t))

AFFECTED AREA: This order applies to all areas, roads and trails on National Forest System lands within the boundaries of the Dakota Prairie National Grasslands.

Pursuant to 36 CFR 261.50 (e), the following are exempt from this order:

A. Transporting feeds, straw, hay or mulch on Federal, State or County roads that are not National Grasslands roads or trails.

B. Possession or use of pelletized feed.

C. Persons feeding livestock forage on inventory headquarters allotments (intermingled National Grassland and Private Land allotments) in conducting their commercial livestock operation.

D. Persons with written approval from the District Ranger to use uncertified forage or mulch.

These prohibitions are in addition to the general prohibitions in 36 CFR Part 261, Subpart A.

Violation of these prohibitions or any permit or authorization issued there under is punishable by a fine up to $5,000 for an individual or $10,000 for an organization, or imprisonment for not more than 6 months, or both.
