We are in receipt of your appeal letter dated January 29, 1998.  You are appealing Regional Forester Phil Janik's January 14, 1998, decision to implement a land use fee schedule for current authorization holders _SUPin the Alaska Region.


This appeal is being processed under 36 Code of Federal Regulations (CFR) 251, Subpart C of the Secretary's Appeal Regulations.  In accordance with 36 CFR 251.80, this particular decision can only be appealed by a holder of a written authorization to occupy and use National Forest System lands.  Therefore, we are dismissing your appeal pursuant to 36 CFR 251.92(a)(1).


However, since the permit holder, Mr. Montgomery Irvin, referenced your letter in his appeal dated February 11, 1998, we will incorporate your letter and issue one decision.


This is the final administrative decision of the Department of Agriculture, unless the Secretary elects to review the decision (36 CFR 251.100(c)).  At the end of the discretionary review period, we will notify you of his determination.
