PART 4G36 - CONSTRUCTION AND ARCHITECT-ENGINEER CONTRACTS   Subpart 4G36.1--General 4G36.104 Policy. Award of construction or architect-engineer contracts requires the contracting officer to have a warrant meeting the specialty requirements (Department Regulation 5001-1 and FSAR 4G01).   Subpart 4G36.2--Special Aspects of Contracting for Construction 4G36.201 Evaluation of contractor performance.   Follow the procedures specified in 4G42.1503 for using the USDA sponsored system managed by the National Institute of Health (NIH).     (a) Preparation of performance evaluation report.         (2) The project officer/contracting officer representative (COR) is the evaluating official responsible for preparing the performance evaluation reports required by FAR 36.201(a).         (3) The contracting officer is responsible for obtaining the contractor's review/concurrence/rebuttal in accordance with the NIH system procedures.     (b) Review of performance reports. The Forest Engineer or equivalent is responsible for reviewing the technical aspects of performance reports before they are approved by the reviewing official. The reviewing official is the contracting officer.  See additional review procedures described in 4G42.1503 when the contractor does not agree with the performance evaluation.     4G36.204 Disclosure of the magnitude of construction projects. For road construction contracts resulting from purchaser election under the National Forest Management Act, (16 U.S.C. 472a) (timber sale turnbacks), the Government's estimated cost of construction shall normally be announced in the timber sale prospectus and in the solicitation.   Subpart 4G36.6--Architect-Engineer Services 4G36.602 Selection of firms for architect-engineer (A & E) contracts. 4G36.602-1 Selection criteria. As described in 4G15.304(c)(4), additional points may be assigned or credit given to potential contractors that are or will subcontract with certified 8(a) or other small disadvantaged businesses. This procedure will be allowed until units have met their small business goals (Comp. Gen. B-223059, B-223243).   4G36.602-2 Evaluation boards.     (a) Establish evaluation boards on a permanent or ad hoc basis at the location of contract award. Evaluation boards may include preselection boards. Use of outside evaluators is authorized if necessary to meet Government needs.   4G36.602-3 Evaluation board functions.     (b) Selection report approval authority is redelegated to the chief of the contracting office. Authority may be redelegated to an acquisition official above the level of the contracting officer.   4G36.602-4 Selection authority.     (a) Selection authority is redelegated to the chief of the contracting office. Authority may be redelegated to any acquisition official above the level of the contracting officer.   4G36.602-5 Short selection process for contracts not to exceed the simplified acquisition threshold. Either or both of the short processes described in FAR 36.602-5 may be used to select firms for contracts not expected to exceed the simplified acquisition threshold. The contracting officer is the designated selection authority for the purposes of FAR 36.602-5(b)(2).   4G36.603 Collecting data on and appraising firms qualifications.     (a) Establishing offices. Regional Foresters, Station Directors, and the Assistant Director for Operations, Acquisition Management, Washington Office, have the responsibility to: (1) establish and maintain an office or offices responsible for receiving and maintaining data on A and E firms wishing to be considered for contracts within their geographic areas, and (2) furnish to the Director of Acquisition Management, Washington Office, the name, address, and telephone number of the office(s) designated.     (f) Offices designated under paragraph (a) are responsible for compliance with the requirements specified in FAR 36.603 (c), (d), and (e).   4G36.604 Performance evaluation.     (a) The contracting officer is the evaluating official responsible for preparing and signing the performance evaluation reports required by FAR 36.604(a).     (b) The Forest Engineer or the engineer's designee have the responsibility to review the technical aspects of performance reports before they are approved by the reviewing official.  The reviewing official is the chief of the contracting office or the chief's designee.
