                       CHAPTER 30 - GRANTS


31 - NATIONAL GRASSLAND AND LAND UTILIZATION PROJECT LAND.

31.1 - Procedure.  The Department of Agriculture has completed 
the grant program under section 32(c) of the Bankhead-Jones Farm 
Tenant Act.  Generally, National Forest lands are no longer 
available or suitable for transfer under the authorities shown in 
FSM 5572, Grants.  Should an application for appropriation be 
received, follow the responsibility outlined under FSM 5504.  
Procedures for the various authorities follow.

32 - AIRPORTS.  Section 23 of the Airport and Airway Development 
Act of May 21, 1970, as amended by the Airport and Airway 
Development Act of 1982, authorizes the grant of property 
interest owned or contracted by the United States to public 
agencies for airport related uses.  The act specifically exempts 
National Forest lands.

Other lands may be restricted by acts that reserve or dedicate 
them to public use.  The authority to transfer National 
Grasslands and Land Utilization Project Lands is in section 32 
(c) and (d) of the Bankhead-Jones Farm Tenant Act.  Although this 
act does not exempt the lands from transfer, it is necessary to 
consider the restrictions in the Bankhead-Jones Act.  Lands owned 
and controlled by the United States and administered by the 
Forest Service, such as administrative sites outside the National 
Forest, may fall under the provisions of the Airport Act.  If an 
application is made for these lands, the Secretary of Agriculture 
decides whether or not to grant the interests needed for airport 
purposes based on a Forest Service report (Report Control Symbol 
FS-5400-S) and other information.  The Chief determines 
information needed in this report on a case-by-case basis.

If the decision is to grant the interest, the Chief is 
responsible for submitting the Forest Service report with 
recommendations, deed of conveyance, and letter of transmittal 
from the Secretary of Agriculture to the Office of the General 
Counsel.
