DALE ROBERTSON Chief FSH 5409.17 - RIGHTS-OF-WAY ACQUISITION HANDBOOK WO AMENDMENT 5409.17-92-2 EFFECTIVE 7/7/92 CHAPTER 70 - RIGHTS-OF-WAY ACCOMPLISHMENT REPORTING 71 - RIGHTS-OF-WAY ACCOMPLISHMENT REPORTS. 1. Purpose. The purpose of rights-of-way accomplishment reports is to keep the Regional and Washington Offices informed of the road and trail rights-of-way program and its progress and, particularly, to furnish a basis for budget estimates and congressional testimony. 2. Preparation. Prepare two reports as follows: a. The first is the annual Rights-of-way Acquisition Program Report. It provides data on road and trail rights-of-way easements; declarations of taking and other court actions; National Forest right-of-way needs resolved through other lands activities and through cooperative efforts; access corridors secured; temporary easements and permits or licenses; non-access type of rights-of-way; and planned accomplishments for the next fiscal year. Prepare this report on Form FS-5400-25, Rights-of-Way Acquisition Program Report. This form is available electronically. (For direction on obtaining electronic forms, refer to FSH 1309.14, ch. 10.) b. The second is the annual Accomplishment Report--Road Rights-of-way Construction and Use Agreements. Prepare this report on Form FS-5400-26, Program and Accomplishments-Road Construction and Use Agreements. This form is available electronically. Prepare the reports from data from Regional/Forest case files, transportation system plans, rights-of-way acquisition plans, and accounting records. Report areas to the nearest acre, mileage to the nearest tenth of a mile, and timber to the nearest hundred thousand board feet. Additional instructions for completing the reports are included on the forms. 3. Date Due. Each Region shall submit the annual accomplishment reports (para. 3) to the Washington Office, Lands Staff by November 30. 4. Transmittal. Include in the letter transmitting the reports a brief statement concerning any significant access initiatives during the reporting period, such as memorandums of understanding promoting access to National Forest lands or cooperative agreements with States and counties for use, construction, reconstruction, and maintenance of roads during the previous fiscal year. 72 - NATIONAL TRAIL ACCOMPLISHMENT REPORTS. 1. Appalachian Trail. Annually, Regions 8 and 9 shall submit the Appalachian Trail--Right-of-Way and Tract Acquisition Progress Report to the Washington Office, Lands Staff. a. Due Date. October 20. b. Purpose. The report provides information needed to compile a report requested by the National Park Service. c. Preparation. Make the report in the format shown in exhibit 01. The report shall consist of a summary for the Region and for each Forest affected by the trail. The report may be sent with handwritten entries. 2. Pacific Crest Trail. Regions 5 and 6 shall submit annually to the Washington Office, Lands Staff, the Pacific Crest Trail--Right-of-Way and Tract Acquisition Progress Report. a. Due Date. October 20. b. Purpose. The report provides information needed to ensure the $5 million ceiling is not exceeded on expenditures for purchase of rights-of-way contained in section 10 of the National Trails System Act. c. Preparation. Make the report in the format shown in exhibit 01. The report shall consist of a summary for the Region and for each forest affected by the trail.
